Under Rule 6(1) of the Civil Servants (Appointment, Promotion and Transfer) Rules, 1973, the Prime Minister is the appointing authority for posts in BPS-20 and above or equivalent.
For promotions to BPS-20 and BPS-21, the relevant Selection Board makes recommendations under the applicable rules.
Under the relevant provisions of the Civil Servants Act, 1973, the services of a civil servant appointed on a temporary or ad-hoc basis may be terminated by giving 14 days’ notice or pay in lieu of notice, as applicable.
This provision allows the government to terminate such employment without treating it as permanent service.
The applicable appointment terms and service rules should be consulted for the specific case.
Under Section 6(3)(b) of the Civil Servants Act, 1973, a civil servant appointed on probation through promotion who fails the prescribed examination or training within the original or extended probation period is reverted to the post from which they were promoted.
If no previous post exists against which the civil servant holds a lien, they may be discharged from service.
Failure does not result in automatic confirmation or permanent dismissal.
Section 6(3)(a) of the Civil Servants Act, 1973, provides that a person appointed through initial recruitment shall be discharged if they fail the prescribed examination or training before the end of the original or extended probation period, unless otherwise prescribed.
A civil servant appointed through promotion or transfer may instead be reverted to the previous post, subject to the Act.
Successful completion of the required training and examinations is an important condition for satisfactory completion of probation.
Under Section 2(1)(b) of the Civil Servants Act, 1973, a civil servant includes a person who is a member of an All-Pakistan Service or a civil service of the Federation, or holds a civil post in connection with the affairs of the Federation.
A person on deputation to the Federation is generally excluded from the definition of a civil servant under the Act.
